The Hotel Excellence Riviera is sold as a 5 star luxury hotel by British tour operators. It is located on the beach with the world's second largest barrier reef on its doorstep. Despite its facilities, the hotel has been subject to a number of illness claims in the last three years.
This claim was brought pursuant to the 1992 Package Travel Regulations for the 'improper performance of the contract# against the Global Travel Group.
Liability was denied throughout by the tour operator but settlement was finally achieved out of court to the relief of our client.
Shigella is a serious intestinal infection often causing severe, prolonged diarrhoea and abdominal cramps – only a small amount of bacteria is required to spread the infection.
The bug is known to spread and cause disease amongst small groups of holidaymakers or large numbers of persons. Shigella dysentery can be water-borne or food-borne, but it can easily be passed from person to person either directly of through the environment.
